By participating in the Program, you signify your acceptance of these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not participate in the Program.
Description of Program
The Program includes training, testing, and certification services for individuals seeking to obtain a CDL. The Program is provided on an “as is” and “as available” basis. We reserve the right to modify or discontinue the Program at any time, with or without notice to you. We will not be liable to you or any third party for any modification, suspension or discontinuance of the Program.
Eligibility
To be eligible for the Program, you must meet all state and federal requirements for obtaining a CDL, including but not limited to having a valid driver’s license, passing a physical examination, and having a clear driving record.
Enrollment and Fees
Enrollment in the Program requires a non-refundable enrollment fee. Additional fees may be charged for training materials, testing, and certification services. All fees are subject to change and will be confirmed at the time of enrollment.
Attendance and Progress
Regular attendance and active participation are required for the successful completion of the Program. If a student fails to attend a scheduled class or falls behind in coursework, the student may be removed from the Program at the discretion of the Program administrator.
Refunds
All fees paid to the Program are non-refundable, unless otherwise required by law.
Prohibited Conduct
You may not engage in any conduct that is disruptive to the Program or to other students. This includes but is not limited to cheating, plagiarism, or any other forms of academic dishonesty. Any prohibited conduct may result in removal from the Program.
Intellectual Property Rights
All materials and content provided in the Program, including but not limited to text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“Content”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to the Company, subject to copyright and other intellectual property rights under the law. The Content and the Marks are provided on the Program “AS IS” for your information and personal use only.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR PARTICIPATION IN THE PROGRAM; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PROGRAM, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER STUDENTS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE PROGRAM;
Welcome Package
If you have signed the Welcome Package, including the Welcome Letter, CDL COURSE COMMITMENT LETTER, and Employment Commitment Letter, as a part of the DRIVE CAMDEN CDL Program, and have received any payment or bonuses from BUSPASS, all agreements and commitments in the Welcome Package are binding. If you do not fulfill the obligations stated in the Welcome Package, you will be required to repay the bonus payment and a $125 permit fee.
Breach of Terms
If you breach any of the terms and conditions of this agreement, we reserve the right to terminate your participation in the Program and/or deny you access to the Program without notice and without liability to you.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of your origin, without giving effect to any principles of conflicts of law.
Dispute Resolution
Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in accordance with the JAMS International Arbitration Rules. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be London. The language to be used in the arbitral proceedings shall be English.
Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
